Investigation Finds ATV In Fatal Accident Was Out Of Gas

Easton police say an ATV operator killed in an an accident on Route 59 in January was not riding the vehicle at the time, but was behind the ATV,  which was out of fuel.  18-year-old Robert Smuniewski of Easton was killed in the accident January 8th.

Police say Smuniewski had previously been issued a summons for riding an ATV on the roadway, and that he was wearing dark clothing,  on an overcast day, on a stretch of two-lane road without street lights which had patches of ice and snow.  They say prosecutors reviewed the findings,  and found no reason to charge the driver of the car,  84-year-old Stewart Lahey of Bridgerport.
