Hearing On Cheshire Motions Scheduled For Next Week

A motion by the defense team for the second defendant in the Cheshire home invasion murders,  to disqualify the judge in the case will be heard next Tuesday, Feb. 15, in New Haven Superior Court.  The lawyers for Joshua Komisarjevsky filed a series of motions Friday,  including one asking that Judge Jon Blue be taken off the case.

Judge Blue was on the bench for the trial of Steven Hayes, who was convicted in the deaths of Jennifer Hawke-Petit and her daughters at their Cheshire home.  The Komisarjevsky motion argues that he sometimes cut off defense witnesses,  and that he once offered cookies to courtroom spectators before the day’s testimony got underway.

Judge Blue’s order says if the motion before Judge Brian Fischer is granted, the case will be reassigned.  If the motion is denied,  Judge Blue will hear the remaining motions,  including one to move the location of the trial out of New Haven County.
